General Conditions of Sale

These General Conditions of Sale are deemed to be fully read and accepted by the simple booking and/or payment of any service purchased by the consumer/customer. We Can Race s.r.l. (hereinafter referred to as "WCR") reserves the right to unilaterally modify these General Conditions of Sale at any time, which will be promptly updated/published on the website and available at any time at the following page: https://wecanrace.it/condizioni-generali-di-vendita. It is understood that the Customer is bound only by the version of the General Conditions of Sale accepted at the time of purchase. Information relating to services offered on "WCR WEB Sites" is constantly updated; the possibility of inaccuracies or errors is not excluded, therefore WCR reserves the right to correct information at any time without having to give notice.

"WCR WEB Sites" means all websites, as well as external web pages, blogs, forums and web content, accessible through domains and subdomains, always owned or managed exclusively by WCR; "Customer" means the person who registers on the "WCR WEB sites" and completes the purchase procedure and the Customer may or may not coincide with the person who uses the purchased service; "Driver/Participant/User" means the person who actually uses the service and experiences driving a SuperCar, or as a passenger in the case of the Breathtaking Ride; "Pilot/Co-Pilot/Instructor" means the qualified person who during the Technical Briefing, Driving Course and/or during the Driving Session (as they sit next to the Driver) gives driving directives/instructions to experience in complete safety; "Guest/Companion" means the person with whom the Driver shares the racetrack experience (without clearly driving the car or accessing the Supercars as a passenger); "Guest Pass" means the entrance ticket that must be purchased to access our events as a Guest to accompany Participants and share the racetrack experience with them; "Event" means the day when WCR sets up and organizes the host structure (racetrack) to allow Participants to use the purchased service and additional services connected to it; "Driving Experience" means driving on track at the wheel of a Supercar within the host circuit, carried out during an event; "Convocation" means the communication sent to the Customer by email, up to 3 days before the event, indicating the time and day when they must present themselves at the Racetrack, a reminder of the documents to be shown and a brief summary of how the experience will take place; "Invitation" means the communication sent as a reminder of the event to the Customer in possession of an Open Date or Fixed Date package at that specific Circuit; "Lap" means the section of track covered starting from the pits and returning to the pits; "Straight" means the section of the circuit/racetrack that follows a straight course, without curves; "Reconnaissance lap" means the lap in WCR cars (shuttles, vans, minivans or SUVs from 5 to 12 seats or other) driven by a Pilot to show Drivers and Guests the entire circuit; "Pits" means the hospitality area that welcomes the Team, participants and companions, located immediately after the starting line, with direct visibility of the track; "Pit-lane" means the lane where the Teams are, which deviates from the track and is intended for vehicles going to the pits (often parallel to the circuit straight); "Technical briefing" also called "brief theoretical sports driving course" means the set of theoretical notions for safe driving, given by the Pilot/Instructor before getting on board the cars; "Driving Session" means the time spent in the car at the wheel of the SuperCar and can last from 1 to several laps; "Open bar" means a welcome buffet for Drivers and Guests, consisting of sweet and savory snacks, drinks, water excluding coffee, served or self-service – not available at all racetracks; "Costs and Expenses incurred by the Customer" means all those costs and expenses that the Driver and/or Companions incur to reach the racetrack and experience on track (eg: transfer, travel, hotel, restaurant, parking); "Gift Card" means a digital voucher of the indicated value that expires in 36 (thirty-six months) to which discount codes cannot be applied and cannot be used in cases of automatic discount and sale periods in the cart/check-out, such as occurs during Black Friday, Cyber Monday or other discount occasions.

The company We Can Race S.r.l., with registered office at via Ospedale Vecchio n.3 c/o NEST SRL STP – 33170 – Pordenone (PN) – VAT number 00951680941, carries out e-commerce activities through WCR WEB Sites. WCR owns all editorial and multimedia content, which is therefore protected by Industrial and/or Intellectual Property Law, as also indicated in the footer of its Web Sites. It is not permitted to use or dispose of the content and information present on WCR WEB Sites.

These General Conditions of Sale apply to all products sold through WCR "WEB sites" and through various commercial partners (e.g. Cofanetti Sport, Groupon, other suppliers with co-marketing agreements). The Customer acknowledges that to purchase the services proposed and sold on WCR Web Sites, it is necessary to read and accept the General Conditions of Sale available on the site; The language available for closing the contract is Italian; Events organized by WCR take place, for safety reasons, exclusively at racetracks or other structures, always closed to traffic, dedicated to driving activities; The Customer acknowledges that, for organizational, technical or car maintenance reasons, WCR may not make available to the event some of the models chosen by the Customer during purchase. In this case, the Customer or the Driver will be offered, at no additional cost, driving an equivalent or higher category model; Images of events and cars published on the site and car colors are to be considered purely demonstrative; In no case is reimbursement provided for Costs and Expenses incurred by the Customer.

This telematic contract has as its object the sale and supply by WCR of the driving experience service at the wheel of a WCR GT Car (road supercars) on Italian circuits, or the experience as a passenger of the aforementioned cars, in the case of the Breathtaking Ride, as well as additional services connected to them.

The service includes the services described in detail in the online purchase process or in the paper or electronic documentation provided by WCR at the time of purchase. The Customer also has the possibility to purchase additional services or special packages, better specified below. ☛ In most Italian racetracks and circuits, the main straight is parallel to the pit lane, i.e. the lane where the Teams are. From this lane, therefore from the pits, the Participant gets into the car to start their driving experience and ends it. When starting with the car, they slowly travel the Pitlane, alongside the track straight and enter the track almost at the end of the straight itself. The exit from the track, therefore the return to the pits, is often at the beginning of the straight itself. Therefore, choosing to do just one lap, coverage of the main straight is not guaranteed, depending on the circuit layout.

WCR publishes its services on "WCR WEB sites", complete with the following information: price including VAT, available cars and circuits, date of the experience, availability, expected payment methods, guarantees offered to the customer, additional services and special packages. The Customer can proceed with the purchase of services offered by WCR through "WCR WEB sites", only by correctly carrying out the following procedure: A) the Customer registers by providing their personal data and those necessary for their identification also for tax purposes; B) the Customer reads and accepts these General Conditions of Sale; C) the Customer carefully reads the information on the processing of personal data and gives consent, where deemed appropriate; D) the Customer chooses the methods of carrying out the experience such as the car, the circuit, the number of laps to be carried out, the date, and any additional services; E) the Customer finally proceeds to confirm and send the order. WCR in turn confirms the conclusion of the sales contract, through an automatic email with the subject "Order Confirmation", sent to the email address indicated by the Customer during registration. The purchase is valid and confirmed only if followed by total and regular payment. Otherwise, the purchase is not considered completed. Only upon completed payment, the VOUCHER will be sent in PDF via email or WhatsApp. The price of each service is that published at the time of order completion; if it should vary, the Customer is still applied the one in force at the time of confirmation of their order. The price of the experience is variable based on the length of the racetrack, its prestige, the car chosen and seasonality.

WCR accepts the following payment methods: Paypal, Stripe, Credit cards, Debit cards, Rechargeable cards, PostePay, AmazonPay, ApplePay, Bank Transfer, Small Pay. Payment by bank transfer must be made in favor of WE CAN RACE S.r.l. to the bank details provided in the Order Confirmation email; the reason to be reported on the bank transfer must indicate the order number communicated to the Customer with the aforementioned automatic email. The contract is binding for WCR only and exclusively upon receipt of the amount due. In case of payment by Bank Transfer, if within 7 days from the conclusion of the contract, WCR does not receive payment credit, it may proceed to cancel the order without any notice. WCR provides the possibility to block your purchase with the payment of a sum of money as a confirmatory deposit, and to make the balance payment, in cash or by card, directly at the racetrack on the day set for the event, during customer acceptance/registration. The purchase of the chosen package (Car/Circuit/Number of laps) is not considered completed until WCR receives the entire established amount. If defaulting, the Participant will lose the deposit paid and will lose all rights to use the service, including partial rights with respect to the deposit paid.

Within THREE days of the date chosen for the experience, WCR will send the Customer a convocation email or WhatsApp, indicating the time when they must present themselves at the Racetrack, a reminder of the necessary documents to bring and a brief summary of how the experience will take place. ☛ If the Customer wishes to change the convocation time (not the date) they can reply to the received convocation email, indicating their preferred time slot; WCR will do its best to make the change depending on availability, but cannot guarantee to satisfy the request. If the Customer, during purchase, selected the Open Date, it will be their responsibility to check the available dates in the calendar on WCR Web Sites and send an email to [email protected] indicating their order number and preference, in due time respecting the 24-month validity period from the package purchase date. ➤ The date and time indicated in the Convocation must be strictly respected; therefore, if the Customer presents themselves late, or does not present themselves in time to attend the Technical Briefing, or does not present themselves to the event at all, they lose all rights to use the service.

Based on the convocation time, participants are divided into groups and each group attends a theoretical technical briefing held by an Instructor/Pilot, aimed at illustrating the rules of conduct that must be respected by all participants during the Driving Session. WCR's objective is to provide a great driving experience at its best and in complete safety. In no case can the Driver drive the SuperCar on track and use the purchased laps if they have not actively participated in the Technical Briefing beforehand. Failure to comply with these rules and/or those given during the Driving Session by the Pilot/Instructor, gives WCR staff the right to immediately interrupt it and remove anyone deemed dangerous while driving the car. In this case, WCR, within 20 days following this event, will refund the laps not carried out, deducting the part of fixed costs incurred for their participation in the event, any options/accessories and insurance chosen by the Customer.

1.) The Customer is obliged to print and keep these General Conditions of Sale and the information relating to the processing of personal data, which, upon completion of the order, are deemed to be fully accepted. 2.) The Customer is obliged to provide truthful and not false data throughout the order completion and payment phase. 3.) The Customer is obliged, in case of purchase intended for third-party users (Driver Participant different from the Customer - for example in case of a gift), to provide, when requested by WCR, the personal data of the third party and is also obliged to ensure that they have the necessary requirements to enjoy the service, detailed in the appropriate paragraph. 4.) The Customer and the Participant are jointly responsible for damages that may occur to WCR as a result of non-compliance with the obligations referred to in paragraphs a, b, c of this article. 5.) The Participant is obliged to always respect the rules of conduct illustrated during the Briefing and/or those given during the Driving Session, in order not to endanger their own safety and that of third parties, thus avoiding dangerous overtaking, reversing, sudden and reckless movements, etc. under penalty of immediate interruption of the Driving Session. 6.) The Participant is obliged to present themselves punctually at the chosen circuit, at the time indicated in the convocation email, following the instructions provided, under penalty of loss of all rights to use the service (as provided in art. 9). The Participant cannot in any case access the Driving Session if they have not actively participated in and followed the technical briefing beforehand (as provided in art. 10). 7.) The Participant is obliged to present a valid "category B" or higher driving license, otherwise the service cannot be provided and the ticket will not be refundable. Nevertheless, WCR can give the possibility to experience on board the supercar as a passenger. 8.) The use of mobile phones during all practical and theoretical activities is prohibited, to avoid distractions. 9.) The use of your own recording devices (e.g.: mobile phone, video camera, action cam, etc.) during the entire Driving Session is prohibited. 10.) It is mandatory to fasten seat belts at all times while driving. 11.) It is mandatory to wear a helmet at all times while driving. 12.) The use of sports shoes is mandatory. 13.) For any experience on board supercars involving a minor (only minors over 6 years of age admitted), it is necessary that they be accompanied by at least one parent, who, during registration at the Desk, accepting the following conditions, declares to have already obtained the consent of the parent not present.

The Customer and/or if different the Participant, to participate in the event, declares: to be 18 years old and not over 75 years old, to be no taller than 200 cm., to weigh no more than 110 kg; to be in possession of a valid "category B" or higher driving license to be presented in original on the day of the meeting (photos or duplicates of said document are not admitted) (ref. 11 lett.g); to have never received a refusal to participate in any type of sports activity; to be in perfect psycho-physical health that allows them to carry out the stage driving session in complete safety; not to use drugs that may affect the state of vigilance or that may compromise reflexes and physical performance; to refrain, in the 24 hours preceding the experience, from taking alcohol or drugs; not to be affected by pathologies that may jeopardize perfect physical fitness for sports activity; in this case they are required to declare it before purchase and WCR reserves the right to request a specific medical certificate of fitness before completing the contract. In case of purchase intended for third-party users (Gift), the Customer is obliged to ensure that the Participant has the aforementioned requirements, necessary to enjoy the service, under penalty of loss of all rights to use the service.

The Customer accepts that, as the Contract has as its object the provision of leisure services that WeCanRace undertakes to provide on specific dates, the Contract, pursuant to art. 59, paragraph I, lett. n) of the Consumer Code, the right of withdrawal provided for in art. 52 of the Consumer Code does not apply. The Customer will therefore not be able to exercise this right in relation to the purchase of experiences, optionals and related gift boxes or gift cards always convertible into the same experiences. This right cannot be exercised even when an event is canceled for reasons of force majeure and postponed to a later date.

WCR reserves the right to cancel and postpone even partially, or suspend even partially, the event if the number of participants does not reach the expected minimum, or for any cause of force majeure, or due to unavailability of the racetrack or mechanical or body damage to WCR SuperCars that should occur before or during the event itself and that will not be repairable in time for the continuation of the event itself. For each of these cases, WCR will guarantee the Customer the right to use the service not enjoyed (totally or partially) on another date and/or circuit made available by WCR. The cancellation, postponement and/or sudden suspension of the event for one of the mentioned causes, never gives, in any case, any right to Customers and/or Drivers to claim compensation or refunds for Costs and Expenses incurred by the Customer, but only to recover the experience not enjoyed. Participants will be notified ten days before the set date and will have the possibility to choose another later date under the same conditions of the purchased service and same racetrack or at a different racetrack, but which guarantees at least the same circuit length or greater. Following the cancellation of the event on the date originally chosen by the Customer, the validity of the purchased service will be extended and the 24 months will start from the date on which the cancellation is communicated. If the Customer chooses to use a service or package of higher price than that paid, they must pay the difference to WCR; if instead they choose to use a service or package of lower price, they accrue a credit for the difference not enjoyed to be used for a subsequent purchase. ➤ In case the Driver, at their discretion, does not present themselves on track on the day of convocation, they will lose all rights connected to registration as well as the total amount paid, without any right to postponement of the experience, return of sums and reimbursement for Costs and Expenses incurred by the Customer.

Before accessing the track, the Participant will sign a Declaration of Assumption of Responsibility that releases, renouncing any action of recourse, the organizers, instructors, WCR and the racetrack/host company from all civil, criminal and administrative liability for damage to vehicles, things, their own person, third parties and/or the Pilot/Instructor deriving from their reckless and negligent behavior and from non-compliance with safety rules and technical directives given during the Technical Briefing or by the co-pilot during the Driving session. WCR, included in the product price, guarantees insurance coverage – within the limits of the ceiling – for any material impact damage caused by the Customer and/or Participant to the vehicle used, only and exclusively in cases where the Driver has respected the aforementioned directives/instructions and safety rules. Therefore, the insurance, in no case, compensates for any accidents deriving from non-compliance with the aforementioned directives/instructions and safety rules; in this case, the Participant remains exclusively responsible for any civil and criminal liability and any commercial and image damage that may result. The supervision of the Pilot/Instructor during activities does not in any way constitute assumption of responsibility on their part. For this purpose, the Customer and/or the Driver, by accepting these General Conditions of Sale, grants broad authorization to WCR staff to view and use audio/video recordings recorded during the driving session for a more accurate and objective analysis of the facts, subject of any dispute raised by both parties (company and Customer), or subject of driving interruption, accidents and incidents occurred during the experience. The aforementioned authorization also applies to pre-trial and judicial pathological phases, for sending files to insurance companies and racetracks and/or third parties who request them.

In case of adverse weather conditions (e.g.: heavy rain, hail, ice, flooding, fog, etc.) the Circuit Management may deem it appropriate to close the track even suddenly or, independently, WCR may deem that the safety and practicability conditions of the same are compromised and suspend, even partially, the event (ref. art.14) – in this case the Customer can recover the experience by agreeing with WCR on a new date (always respecting the car and racetrack already chosen in the purchased package). The Weather Insurance does not exhaust its validity, which also extends to the subsequent agreed date. The postponement and/or sudden suspension of the event for one of the mentioned causes, does not give any right to claim compensation or refunds for Costs and Expenses incurred by the Customer, but only to recover the experience not enjoyed.

The "Flex/Weather" service is an additional service that the Customer or Participant can purchase at the cost indicated on the site, simultaneously or subsequently to the purchase of the Track Lap service, but up to thirty days before the date chosen for the event. The "Flex/Weather" service allows the Customer, whatever the reason (personal or related to weather conditions) to postpone the date of the event for which they had previously booked, or to change the chosen car, up to 48 hours before the event itself, by sending an email to [email protected], indicating their order number. It can be used only once throughout the validity period of the purchase and allows, in case of booking cancellation, to book for one of the subsequent dates always falling within the 24-month validity period of the package from the purchase date. The additional "Flex/Weather" service relates to the single purchase; if subsequently the experience is integrated with the purchase of additional laps or other experiences/packages, it is necessary to ensure to add for each purchase the same extra services desired.

The Video Memory is an additional service that the Customer or Driver can purchase at the cost indicated on the site when purchasing the service. It consists of HD video recording with Audio of the driving experience, with the aid of professional cameras. 3 variants are available. TRACK VIDEO: The Track Video is a single HD 16:9 (1280×720) recording where the camera is fixed at the rear between the driver and co-pilot. It captures part of the cockpit and the track in POV format. The recording includes the overlay of the car's telemetry and the car's position in real time on the track layout. SELFIE VIDEO: The Selfie Video is a single FULL HD 16:9 (1280×720) recording where the camera is fixed on the front windshield, passenger side, to capture all the emotions of your face and body inside the car cockpit. The recording does not include the overlay of telemetry and GPS. TRIOMIX VIDEO: With the purchase of TrioMix Video you will receive 3 videos: the Track video, the Selfie video and a synchronized montage of the two videos in vertical 9:16 format in HD. The Video Memory of the experience is uploaded to a cloud server and the link is sent to the Participant's email address and WhatsApp number approximately 15 working days after the track event. The Video Memory refers to a single driving session, therefore if the purchase consists of a combination of laps in different cars and/or special packages, the Customer must indicate the preference of the specific single driving session for which they wish to receive the video or purchase additional Video Memories for as many cars as they will drive. The additional "Video Memory" service relates to the experience with the single chosen car: if you purchase an experience on more than one car, you must ensure to add for each car the same extras desired. The video memory is separate from the experience: if it should be damaged or not functioning correctly, in whole or in part, due to technical problems or poor GPS signal, WCR will refund the amount paid exclusively for the track recording service. In case of problems with telemetry (in TRACK VIDEO), only the service not delivered will be refunded, i.e. the difference with SELFIE VIDEO (generally between 5 and 10 euros). In case of purchase of TRIOMIX VIDEO and the SELFIE VIDEO is damaged or not recorded, the available video will be delivered and a refund will be made of the amount paid for the video memory minus the cost of the delivered video.

"VIP & SKIP THE LINE" is an additional service that the Customer or Driver can purchase at the cost indicated on the site when purchasing the service. It allows the customer to receive, 20 days before the event for which they have booked, a reminder by email and WhatsApp to the email address and number indicated at purchase and also allows them to choose (up to 10 days before the event) a specific time slot in which to be convened and therefore present themselves at the circuit. The "VIP & SKIP THE LINE" service guarantees the preferential lane both during check-in and on track, allowing the Customer to skip queues should they form. The additional "VIP & SKIP THE LINE" service relates to the single package (car, circuit and chosen date): if you purchase an experience on more than one car or circuit, you must ensure to add the same extra services desired.

The Guest Pass is part of additional services and is intended as an entrance ticket that must be purchased to access our events as a Guest to accompany Participants and share the racetrack experience with them. The Guest does not drive and does not access the Supercar even as a passenger, even if they are approved for 4 seats. The Guest Pass entitles to a series of exclusive services such as: 1)Parking, 2)Access to PitLane 3)OpenBar Drink & Food 4)Theoretical track driving course held by certified pilots/instructors 5)Circuit reconnaissance lap aboard a minivan/suv (where possible) 6)Photos and Videos in Pit-Lane 7)WCR Gadget 8) Final greetings. The Guest Pass will be delivered at the racetrack on the day of the event, is personal and non-transferable to third parties. It is free for children under 12; at the event you must present yourself with a valid document attesting to the child's date of birth, to be presented at the Desk during registration. In case of loss, the Guest Pass must be purchased again.

The "Open Date" option allows the Customer not to commit to a predetermined date already at the time of purchase, but to decide the date of the event at a time subsequent to purchase, choosing from those available on WCR WEB Sites and sending an email to [email protected] with the indication of their order reference and preference, within a maximum of thirty days before the event. From the purchase date, the Customer will have 24 months to use the service and can therefore comfortably choose in due time for which event to book.

The "Date Change" service is a service that allows changing the date of the event for which you have booked, with at least thirty days' notice before that date, simply by sending an email to [email protected] with the indication of your order reference and alternative date preference.

The GIFT CARD can be purchased or generated from a conversion of one of our gift boxes for the value indicated at purchase as indicated in the confirmation email. The purchase of a gift box (convertible into a Gift Card) or the direct purchase of a GIFT CARD can also be made using a discount voucher and for this reason, its subsequent use cannot be subject to discounts again. The GIFT CARD is not linked to any name, not even that of the customer who purchased it: it is bearer and requires registration by the user who can do so when converting into a purchase only on WCR sites. It can be converted or spent only on WCR sites and is equipped with a double code: a serial and a control figure necessary for activation. Anyone in possession of these two codes can activate it and use it only once and it can be converted into any product, except for the purchase of a new gift card box.

The "Conversion with Other Experiences" option is a service that allows the Customer to convert their purchase, up to thirty days before the date of the event for which they have booked, into a credit equal to the amount spent for the purchased package.

If the Customer or User wishes to book an experience for an event falling on a date after the expiry of their experience, or more simply wants to EXTEND THE VALIDITY of their experience by 12 months from expiry, they can do so by paying a fee of 30% of the gross value of the same experience and all related Options at current prices displayed on our website (the value must also consider all options, such as, by way of example and not exhaustive, additional laps, Companion Passes, VIP & SkipLine, Video Memory, etc.). Discounts, coupons or other reductions cannot be applied to said fee. This VALIDITY EXTENSION option is always activatable during the validity period of the experience. In case the unused experience has already expired, only within 3 months from expiry, the Customer or User can RENEW THE EXPIRY to 12 months under the same conditions as the Validity Extension.

✎ The Customer and each Companion with whom the participant shares the event, are required to sign a comprehensive waiver, which is provided free of charge and with unlimited validity over time, as explicit consent to the use and publication of photographic images and audio/video recordings (that portray them alone or together with other people during events, for any commercial, publication and promotional purposes) on all WCR WEB Sites and its Social channels (pursuant to art. 10 of the Civil Code and arts. 96 and 97 of law 22.4.1941, no. 633). These images and videos can therefore be used to promote their activity also during events, fairs and any type of manifestations.

Pursuant to Regulation (EU) 2016/679 which came into force on 25.05.2018 on the PROTECTION OF PERSONAL DATA (GDPR) and request for consent to the processing of the Data Subject's personal data, WCR informs the Customer that the personal data provided will be subject to processing in compliance with the aforementioned regulation. For the use and publication of photographic images and audio/video recordings, which portray the Customer/Participant and each companion during the event, reference is made to art. 22 of these General Conditions of Sale. Any dispute arising from purchase contracts for services through "WCR WEB sites" and their relative use is subject to Italian jurisdiction and the competent court is that of Santa Maria Capua Vetere (CE). The Customer/Participant declares to accept all conditions established by WE CAN RACE S.r.l. The Customer/Participant also declares to have carefully read and evaluated the content of this contract and to have clearly understood the meaning of each individual article before signing it. For the purposes of arts. 1341 and 1342 of the Civil Code, therefore declares to specifically approve articles 4, 5, 7, 9, 10, 11, 12, 13, 16, 22, 23, 24, 25 of this document.
